Why do I need a Will?

· It is a common misconception that your spouse/partner will automatically inherit your estate. This is not always the case.

· You choose your executors and beneficiaries ensuring that only those who you wish to inherit your estate do so. If you do not have a will in place, it could be that an estranged family member could be entitled to a share of your estate.

· It is cheaper to leave a Will than not to.

· You can state your funeral wishes, making it a little easier for your loved ones.

· You can appoint guardians to children aged under 16.

What is a Power of Attorney and why do I need one?

· No one automatically has the right to make decisions for you should you become incapable either mentally or physically of managing your own affairs. By granting a Power of Attorney you have someone of your choice to act on your behalf should you lose capacity.

· Your attorney(s) can effectively step into your shoes and make decisions in relation to your finances and welfare matters that you are no longer able to make for yourself.

· Should you lose capacity without a Power of Attorney in place a Guardianship order would be required. This needs a court order which is expensive to obtain and takes many months to put in place.

· Everyone should have a Power of Attorney. It is like an insurance policy, it is there in case you need it in the hope that you never do.
